The EU Air Passenger Rights Regulation (Regulation (EC) No 261/2004) governs the compensation rights of air passengers, including business travelers, in the event of flight delays, cancellations or denied boarding. This regulation aims to provide passengers with adequate protection and fair compensation, regardless of whether the flight is part of a private or business trip. 

Eligibility
  • The passenger, i.e. the person who actually took the flight, is entitled to compensation, regardless of who paid the bill. 
  • For business travelers, this means that they, and not the company, can assert the claim, unless otherwise contractually agreed. 
Conditions for compensation

1. delay: 

  • From a departure delay of two hours, you are entitled to care services such as drinks, meals and, if applicable, accommodation. 
  • From a delay of three hours, you are entitled to financial compensation. 

 2. cancellation: 

  • For canceled flights, you are also entitled to compensation unless you were informed at least 14 days before the scheduled departure. 

 

3. denied boarding: 

  • If you are denied boarding, e.g. due to overbooking, you are also entitled to compensation.

Amount of compensation
  • The amount of compensation depends on the flight distance: 
  • € 250 euros for flights up to 1,500 km
  • € 400 euros for flights within the EU over 1,500 km and for all other flights between 1,500  and 3,500 km
  • € 600 euros for flights over 3,500 km
Exceptions

However, there are exceptions where the airline does not have to pay compensation, for example in exceptional circumstances such as extreme weather or political unrest. 

Submitting the claim:
  • You will need the flight number, date and your name to submit the compensation claim. 
  • However, if your contract with your company makes it clear that you are not entitled to compensation, you must not make a claim without the company’s knowledge.
