What compensation is available for delayed flights in Canada?

In Canada, there are clear rules for compensation for delayed flights, depending on the size of the airline and the length of the delay. This compensation applies to flights within Canada as well as international flights to and from Canada.

Compensation for delays

Large airlines (more than 2 million passengers in the last two years):

 

  1. 3 to 6 hours delay: $400 CAD
  2. 6 to 9 hours delay: $700 CAD
  3. more than 9 hours delay: $1,000 CAD

 

Small airlines (less than 2 million passengers in the last two years):

 

  1. 3 to 6 hours delay:             $125 CAD
  2. 6 to 9 hours delay:             $250 CAD
  3. more than 9 hours delay: $500 CAD

Requirements for compensation
  1. self-inflicted delays: The airline is only liable to pay if the delay was caused by it or could have been prevented by it.
  2. force majeure: In cases of force majeure, such as extreme weather or terrorist attacks, the airlines are not obliged to pay compensation.
Right to assistance

In addition to financial compensation, airlines are also obliged to provide assistance such as meals, drinks and accommodation in the event of delays and flight cancellations. In the event of long delays, airlines must give passengers the opportunity to leave the aircraft.

Filing an application

Passengers have up to one year to apply for compensation. The airline then has 30 days to either pay the compensation or give a reasoned refusal.
